1. Introduction
Welcome to StableGig ("Platform", "Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the StableGig mobile application and web platform.
By accessing or using StableGig, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Definitions
- "User" - Any person who creates an account on StableGig
- "Client" - A User who posts tasks seeking services
- "Tasker" - A User who offers to complete tasks for compensation
- "Task" - A service request posted by a Client
- "Application" - A Tasker's proposal to complete a Task
- "Platform Fee" - The service fee charged by StableGig (currently 5%)
3. Eligibility
To use StableGig, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding contracts
- Not be prohibited from using the Service under applicable laws
- Provide accurate and complete registration information
- Maintain the security of your account credentials
4. Platform Fee Structure
5% Platform Fee Model:
- Client: Pays 5% platform fee (added to task budget)
- Tasker: Receives 100% of agreed task amount
- Payment Processing: Stripe fees apply (2.9% + $0.30 per transaction)
Example: $100 task
- Client pays: $105 (task) + $3.05 (Stripe) = $108.05
- Tasker receives: $100
- StableGig receives: $5 platform fee
5. Escrow System
When a Client accepts a Tasker, payment is charged immediately and held by Stripe (not StableGig) until task completion.
Auto-release: If no action is taken within 14 days of task completion, payment auto-releases to Tasker.
6. Independent Contractor Status
Important: Taskers are independent contractors, not employees of StableGig. Taskers are responsible for:
- Their own taxes and tax reporting
- Their own insurance
- Their own equipment and supplies
- Compliance with local business laws
7. Prohibited Activities
You agree NOT to:
- Violate any laws or regulations
- Infringe on intellectual property rights
- Harass, abuse, or harm other Users
- Post false, misleading, or fraudulent content
- Circumvent payment through the Platform
- Solicit off-platform transactions to avoid fees
- Use the Platform for illegal activities
8. Limitation of Liability
StableGig is a marketplace platform only. We:
- Connect Clients with Taskers
- Facilitate payments and escrow
- Do NOT employ Taskers
- Do NOT provide the services offered in tasks
- Do NOT guarantee task quality or outcomes
TO THE MAXIMUM EXTENT PERMITTED BY LAW, StableGig's total liability is limited to fees paid in the 12 months prior to the claim.
9. Dispute Resolution
Any disputes will be resolved through binding arbitration, not in court, except for small claims court disputes under $10,000.
Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.
